Qencrypt Mobile — Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and FiveRivers Technologies Pvt Ltd ("FiveRivers," "we," "us," or "our") governing your use of the Qencrypt mobile application for iOS (the "App"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
Our Privacy Policy (at the URL you publish and link in the App) describes how we handle personal information and is incorporated into these Terms by reference.

1. The Service

Qencrypt provides tools to encrypt, decrypt, organize, and back up your personal files in a local vault on your supported device, subject to these Terms and the features available under your plan (including any free or paid tier).
We may update, modify, or discontinue features with or without notice where permitted by law. We do not guarantee uninterrupted or error-free operation.

2. Eligibility and account

You must be able to form a binding contract in your jurisdiction and meet any minimum age in your region (typically 13+, or higher where required) to use the App.
If the App allows account creation, you are responsible for accurate registration information and for safeguarding your credentials and master password. You are responsible for activity under your account except where caused by our gross negligence or unauthorized access despite reasonable security.
You may delete your account using in-app controls where provided. Deletion may be irreversible and may remove associated data as described in the App and in our Privacy Policy.

3. Subscriptions and payments (Apple In-App Purchase)

Paid features may be offered as auto-renewing subscriptions processed by Apple via In-App Purchase. You authorize Apple to charge your Apple ID account according to the price and period shown at purchase (e.g. monthly or yearly) and applicable taxes.
Payment: Charges are billed to your Apple ID. We do not receive or store your full payment card number.
Auto-renewal: Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period, unless Apple’s rules or your local consumer laws require otherwise.
Cancellation: You can manage or cancel subscriptions in iOS Settings → Apple ID → Subscriptions (or as Apple provides). Cancellation stops future charges; you may retain access until the end of the current paid period already started.
Free trials / introductory offers: If offered, terms shown at purchase (including trial length and price after trial) apply. If you do not cancel before the trial ends where required, you may be charged the then-current subscription price.
Price changes: Apple or we may change prices where permitted; continued use after notice may constitute acceptance as required by Apple and applicable law.
If a conflict arises between these Terms and Apple’s App Store terms or Apple’s standard end user license for licensed applications, Apple’s terms apply to the extent required for App Store distribution.

4. Free and premium plans

Free tiers may impose limits (for example, daily usage caps, supported file types, or feature restrictions) as described in the App. Premium features require an active subscription or entitlement as shown in the App.
We may change plan features or limits where legally permissible; material adverse changes may be communicated as required by law.

5. Acceptable use

You agree not to:
• Use the App for any unlawful purpose or in violation of third-party rights.
• Attempt to reverse engineer, decompile, or circumvent security or licensing except where applicable law forbids this restriction.
• Use the App to distribute malware, harass others, or overload our systems.
• Misrepresent your identity or misuse another person’s account.
You are solely responsible for lawful use of your encrypted content and for compliance with export, sanctions, and other laws applicable to your data.

6. Your content and license to us

You retain ownership of your files and content. To operate the App, you grant us a limited, non-exclusive license to process your content only as needed to provide the Service (for example, encryption, storage on your device, and features you initiate). This license ends when you delete content or your account, subject to backups and legal retention.
We do not claim ownership of your vault contents.

7. Intellectual property

The App, its name, logos, and related materials are owned by FiveRivers or its licensors and are protected by intellectual property laws. Except for the limited right to use the App under these Terms, no rights are granted to you.

8. Third-party services

The App may integrate or link to third parties (including Apple, analytics providers, or storage you choose). Their terms and privacy policies apply to their services. We are not responsible for third-party services you use with the App.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIVERIVERS AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF LOSS OR UNAUTHORIZED ACCESS.
Security: While we design the App with security in mind, no system is perfectly secure. You are responsible for strong passwords, device security, and backups.
Some jurisdictions do not allow certain disclaimers; in those jurisdictions, our liability is limited to the maximum extent permitted.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIVERIVERS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING FROM YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US DIRECTLY FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (EXCLUDING AMOUNTS PAID THROUGH APPLE FOR IAP, WHICH ARE SUBJECT TO APPLE’S RULES), OR (B) ONE HUNDRED U.S. DOLLARS (USD $100) IF (A) DOES NOT APPLY.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW (INCLUDING CERTAIN RIGHTS FOR CONSUMERS).

11. Indemnity

You will defend and indemnify FiveRivers and its affiliates against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the App, your content, or your violation of these Terms, except to the extent caused by our willful misconduct.

12. Suspension and termination

We may suspend or terminate access to the App if you materially breach these Terms or if required by law. You may stop using the App at any time. Provisions that by their nature should survive (including intellectual property, disclaimers, limitations, and governing law) will survive.

13. Changes to these Terms

We may modify these Terms by posting an updated version and updating the "Last updated" date. If changes are material, we may provide additional notice (for example, in the App). Your continued use after the effective date constitutes acceptance unless applicable law requires a different process.

14. Governing law and disputes

Unless mandatory consumer laws in your country of residence require otherwise, these Terms are governed by the laws of [Insert jurisdiction — e.g. Pakistan], without regard to conflict-of-law rules. Courts in [Insert venue — e.g. Lahore, Pakistan] have exclusive jurisdiction, subject to non-waivable rights you may have as a consumer to sue in your home courts.
If you are in the European Union or United Kingdom, you may also benefit from mandatory consumer protections in your country.

15. Apple-specific provisions

If you obtained the App from the Apple App Store, you acknowledge that:
• These Terms are between you and FiveRivers, not Apple; Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support for the App unless required under Apple’s terms.
• In the event of failure to conform to a valid warranty (if any), you may notify Apple; Apple may refund the purchase price where applicable under Apple’s policies; Apple has no other warranty obligation regarding the App.
• Apple is a third-party beneficiary of these Terms and may enforce the provisions relating to Apple’s rights.
• Apple’s Standard Licensed Application End User License Agreement may also apply as required by Apple for App Store apps.
